Last Updated: March 22, 2026
IMPORTANT: THIS IS A TEMPLATE FOR DEVELOPMENT PURPOSES. It must be reviewed and customized by a licensed attorney before use in production.
Welcome to Community Activities! These Terms of Service ("Terms") govern your use of the Community Activities platform ("Platform," "we," "us," or "our"), operated in the Commonwealth of Virginia. By creating an account or using our Platform, you agree to these Terms.
Please read them carefully.
---
1. WHAT WE DO
Community Activities is an online marketplace that connects parents and guardians who host children's activities ("Hosts") with parents and guardians who want to book those activities for their children ("Bookers"). We provide the technology and tools to help families in local communities discover, organize, and participate in kid-friendly activities.
We are a marketplace only. We do not organize, supervise, or run activities ourselves. Think of us like a bulletin board that helps parents find and coordinate activities with other parents in their neighborhood.
2. WHO CAN USE THE PLATFORM
To use Community Activities, you must:
- Be at least 18 years old.
- Be a parent or legal guardian of a child or children.
- Provide accurate and complete information when creating your account.
- Reside in the United States.
Accounts are for individual use. You may not create an account on behalf of a business or organization without our prior written consent.
3. YOUR ACCOUNT
You are responsible for:
- Keeping your login credentials secure and confidential.
- All activity that occurs under your account.
- Keeping your profile information accurate and up to date, including information about your children.
- Notifying us immediately if you suspect unauthorized use of your account.
We may suspend or terminate your account if we believe you have violated these Terms or if your conduct poses a risk to the community.
4. HOST RESPONSIBILITIES
If you host activities through the Platform, you agree to:
- Provide accurate, truthful descriptions of your activities, including age ranges, location, materials, and any relevant details.
- Maintain appropriate supervision of all children during your activities at all times.
- Ensure a safe environment and take reasonable precautions to prevent injury.
- Communicate promptly with Bookers about any changes, cancellations, or important information.
- Comply with all applicable local, state, and federal laws and regulations.
- Not discriminate against any family on the basis of race, color, religion, national origin, sex, disability, or any other protected status.
- Disclose any relevant experience, certifications, or qualifications honestly.
- Have a plan for handling emergencies, including access to first aid and the ability to contact parents promptly.
Hosts are independent individuals. You are not an employee, contractor, or agent of Community Activities.
5. BOOKER RESPONSIBILITIES
If you book activities through the Platform, you agree to:
- Provide accurate information about your children, including ages, allergies, medical conditions, and any special needs that may be relevant to the activity.
- Communicate with Hosts about any concerns or questions before and after activities.
- Arrive on time for drop-off and pick-up as arranged with the Host.
- Treat Hosts and other families with respect.
- Provide accurate contact information so you can be reached during activities.
6. BOOKING AND CANCELLATION
- Bookings are confirmed through the Platform.
- Cancellation policies are set by individual Hosts and will be displayed on each activity listing.
- If a Host cancels an activity, all Bookers will be notified and any payments will be refunded.
- We reserve the right to cancel bookings or activities that we believe violate these Terms or pose a safety concern.
- Repeated no-shows or last-minute cancellations may result in account restrictions.
7. PAYMENTS
During our beta and soft launch period, activities on the Platform may be offered free of charge. When paid activities become available:
- Payments will be processed through our third-party payment provider (currently Stripe).
- Hosts set their own prices for activities.
- The Platform may charge a service fee, which will be disclosed before you complete a booking.
- Payment terms, refund policies, and payout schedules will be communicated clearly when payment features are enabled.
- You agree to pay all fees associated with your bookings.
- Hosts will receive payouts according to the schedule published on the Platform.
We do not store your full payment card information. All payment processing is handled by Stripe in accordance with their terms of service and privacy policy.
8. PLATFORM ROLE AND DISCLAIMERS
Community Activities is a marketplace only. We want to be very clear about what we are and what we are not:
- We are NOT a childcare provider, daycare, or after-school program.
- We are NOT an employer of Hosts. Hosts are independent individuals.
- We do NOT supervise, direct, or control any activities listed on the Platform.
- We do NOT guarantee the qualifications, background, or fitness of any Host.
- We do NOT verify the safety, quality, or suitability of any activity.
- We do NOT provide insurance coverage for activities.
While we may offer tools such as reviews, ratings, or community vetting features, these are aids for your decision-making and not guarantees of quality or safety. You are responsible for evaluating whether an activity is appropriate for your child.
9. CONTENT AND CONDUCT
By using the Platform, you agree not to:
- Post false, misleading, or fraudulent information.
- Harass, threaten, or abuse other users.
- Use the Platform for any illegal purpose.
- Post content that is hateful, discriminatory, obscene, or harmful.
- Attempt to circumvent the Platform to arrange activities or payments outside of it.
- Collect personal information about other users for unauthorized purposes.
- Upload malware, viruses, or other harmful code.
- Interfere with the operation of the Platform.
Any content you post (activity descriptions, photos, reviews, messages) must be your own original content or content you have permission to use. By posting content on the Platform, you grant us a non-exclusive, royalty-free license to display that content on the Platform for the purpose of operating the service.
We reserve the right to remove any content that violates these Terms.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Community Activities, its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.
- Our total liability to you for any claim arising out of these Terms or your use of the Platform shall not exceed the amount you have paid to us (if any) in the 12 months preceding the claim.
- We are not liable for any injury, illness, property damage, or loss that occurs during activities arranged through the Platform.
- We are not liable for the actions, omissions, or conduct of any Host, Booker, or other user.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Community Activities, its owners, officers, employees, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of:
- Your use of the Platform.
- Your violation of these Terms.
- Any activity you host or participate in through the Platform.
- Your violation of any law or the rights of any third party.
- Any content you post on the Platform.
12. DISPUTE RESOLUTION
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law provisions.
Any dispute arising out of or related to these Terms or the Platform shall be resolved through binding arbitration administered in the Commonwealth of Virginia, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial.
For disputes involving amounts less than $10,000, arbitration may be conducted online or by phone at the election of either party.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
13. TERMINATION
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. You may also delete your account at any time through your profile settings.
Upon termination:
- Your right to use the Platform ceases immediately.
- Any pending bookings may be canceled.
- Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will continue to apply.
14. MODIFICATIONS TO THESE TERMS
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top and notify you through the Platform or via email. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
If you do not agree with the changes, you should stop using the Platform and delete your account.
15. GENERAL PROVISIONS
- Entire Agreement: These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Community Activities.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights at any time.
